1. Agreeing to these terms
This website is operated by Marque Group LLC, doing business as OpenPath Health Solutions (“OpenPath,” “we,” “our,” or “us”). By using it, you agree to these Terms of Use and to our Privacy Policy. If you do not agree, please do not use the site.
2. What OpenPath does
OpenPath is a privately owned insurance marketing and intake company. We help you describe your situation and connect you with a licensed insurance agent who can explain the private PPO, short-term medical, Medicare, and supplemental coverage options available to you.
OpenPath itself does not quote, sell, or bind insurance. Quoting, enrollment, and all licensed sales activity are performed by Safe Shield Health Agency and other licensed agencies listed on our partner agencies page.
3. What this site is not
- It is not a government website. We are not a federal or state agency and are not affiliated with, endorsed by, or authorized by any government program.
- It is not a state or federal health insurance marketplace or exchange. For subsidized marketplace coverage, go to HealthCare.gov. For Medicare, go to Medicare.gov or call 1-800-MEDICARE.
- It does not offer every plan available in your area. What we can present depends on your state, your eligibility, and the carriers our licensed agencies are appointed with.
- It is not medical, legal, tax, or financial advice, and nothing on it is a guarantee of coverage, eligibility, benefits, or cost.
- It does not create an agency, fiduciary, or professional relationship between you and OpenPath.
4. Eligibility
You must be at least 18 years old and legally able to enter into contracts to use this site. If you submit information about another person, you confirm you are authorized to do so and to give consent to be contacted on their behalf.
5. Requesting contact
When you submit a request or check the consent box, you are asking to be contacted. The scope of that consent, who may contact you, and how to stop it are set out in our Privacy Policy §5 and our Do Not Call Policy. Consent is not a condition of purchase, and you may revoke it at any time.
Requests are handled during staffed hours, Mon–Fri, 10am–6pm ET. Agents typically call from their own local numbers rather than the number displayed on this site. Any stated callback timeframe is a service goal, not a contractual commitment.
6. Accuracy of information
We work to keep the site accurate and current, but plan availability, benefits, networks, and pricing change frequently and vary by carrier, state, and individual eligibility. Nothing on this site is an offer, a quote, or a contract of insurance. Only the policy documents issued by an insurance carrier determine what is covered.
You agree that the information you give us is accurate and that the phone number you provide is one you are authorized to receive calls and texts at.
7. Acceptable use
You agree not to:
- Submit false, misleading, or someone else's information without authorization
- Use the site for any unlawful purpose or in violation of any applicable regulation
- Scrape, harvest, crawl, or use automated means to access or collect data from the site
- Attempt to gain unauthorized access to the site, its systems, or related infrastructure
- Introduce malware, interfere with the site's operation, or place unreasonable load on it
- Reverse engineer, copy, or create derivative works from any part of the site
8. Intellectual property
All content on this site — text, graphics, layout, design, logos, and code — is owned by Marque Group LLC or its licensors and is protected by copyright, trademark, and other laws. You may view and print pages for your own personal, non-commercial use. Any other use requires our prior written permission.
Insurance carrier names and logos shown on this site are the trademarks of their respective owners and are used to identify the carriers whose products our licensed agencies are appointed to offer. Their appearance does not imply endorsement of OpenPath by those carriers.
9. Third-party content and links
The site links to and integrates services we do not control, including scheduling, analytics, advertising, communication, and lead-certification providers, as well as external sites such as HealthCare.gov and Medicare.gov. We are not responsible for their content, availability, or practices, and their own terms and privacy policies apply.
10. Disclaimer of warranties
The site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the site will be uninterrupted, timely, secure, or error-free.
11. Limitation of liability
To the fullest extent permitted by law, OpenPath and its officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or business interruption, arising out of or relating to your use of this site — whether based in contract, tort, strict liability, or any other theory, and even if we have been advised of the possibility of such damages.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless OpenPath and its officers, members, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the site, your violation of these terms, or your submission of information you were not authorized to provide.
13. Governing law and disputes
These terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules. You agree that any dispute arising out of or relating to these terms or the site will be brought exclusively in the state or federal courts located in Broward County, Florida, and you consent to the jurisdiction of those courts.
[DECISION NEEDED] If OpenPath wants an arbitration provision, a class-action waiver, or a jury-trial waiver, counsel should draft it here. Those clauses carry their own enforceability and disclosure requirements and should not be improvised.
14. Changes and severability
We may update these terms at any time by posting a revised version with a new “Last updated” date. Continued use of the site after changes take effect means you accept them. If any provision is found unenforceable, the rest remains in force.
